Redundancy pay is effectively given in lieu of some of the money that the employee would have received if their job had continued to exist. If your husband is paying you maintenance you might have a claim against some of his redundancy money, since it's effectively 'pay'. (The downside, of course, is that if your ex remains unemployed, or takes a lower paid job, he could seek to have any future maintenance payments reduced).

If there's no maintenance agreement in place, I can see no reason why you would have any claim upon his redundancy money.

thanks chris, there is no maintenance agreement. he does pay through a cheque every week for my 10 yr old son who he has helped raise.

If you have children together, then i believe you have a claim, as his income has to contribute to your childrens welfare, but if you have no children together, then you have no claim on his redundancy.. The law changed in the 80's , where as a male /husband/dad. could not have his job/business/livelyhood/pension, taken away from him, on the concept of being seperated/divorced.. So if you are divorced, with kids, forget it. If you are seperated with kids, then i think you have a claim.

not sure if this helps, prob best go to advice centre, but if it were me and hed left me for some one else, F**k him off and move on, we women dont need their money anyway

Hi Jevans11,

It might be worth checking with your local Citizens' Advice Bureau but I doubt that you've got any legal entitlement to any part of his redundancy pay. However you could try suggesting that, given that he helps support your son, you (or your son) might have a moral right to some of the money.

Even so, if your ex remains unemployed for any length of time (as may well be very likely at present), getting money from your ex now might simply mean that his cheques will dry up sooner than they otherwise might.

cheers cider, i dont give a stuff about him but he left me 10 grand in debt. he was earning twice as much as i thought he was. he didnt even get son xmas present cos he said he couldnt afford it. he hasnt changed his address so i know how much he has. and your right i dont need his money. but i dont think the bi*ch should get it either.

Been there girl, get a solicitor..( if your so worried) my bloke took a 6 grand car and left me with 15k debt , funny actually, we live on a small estate, saw him the other day, i walked past, head held high, cos i work and i have a nice home and he was outside the pub , fag time.. Forget the loooosers..

Is your son his? you mentioned my 10 year old son who he helped raise? if the child is not his i'm not sure you have any claim for maintenance

I thought if you brought up a child (whether it is your biological child or not ) and fed and clothed it you could be asked to pay maintenance for it.
