Husband has third party insurance on my car.
An accident (with witnesses) has written my car off - not my husbands fault.
My husbands insurers have told him we have to do the work and chase the other mans insurers as we does not have legal aid protection. Are they correct? (Other man is not nice he said he will dispute claim). If it comes to it I will take the man to small claims court myself but up till that point should the insurers not be dealing with each other?

From now on, keep a receipt of everything you spend because of this accident - phone calls, hire car, bus fares, taxis..
Keep a diary of everything to do with the accident and getting another car - every visit you have to make and so on, time off work.
It will all help you with your claim

Accidents on roundabouts can raise all sorts of question - if your husband was already on the roundabout and the TP pulled on to it from a side road and hit him - then I think it should be pretty straightforward and a stern recorded delivery letter letter from you giving the TP 2 weeks to settle or you will take to court should get some action - but if it is an argument about who should have been in which lane or pulled infront of who - it could be complicated and you may need advice. Draw a detailed diagram with lane markings etc and show position of each car - or better still get one of those clever google photos of the location if you can and mark everyones position on it then if you still think you are in the right show it to an expert.

My husband was on the roundabout and the dent is on the side of the car - made with the mans bumper. There is also a witness but we have not approached him yet so he may not reply to us when approached. It was a mini roundabout but I cannot see a lot of difference as a bumper in the side of my car would probably prove positioning.
I will investigate the insurance you mention tomorrow.
