how long does it take before a claim has to be lodged with the court-justice system

My friend has been in a crash coming up to 3 years ago and the other driver was at fault. His insurance company has yet to pay out.
Because of this, she needs to know time frames as her insurance company don't seem to be pro-active in pursuing the matter, and she feels she might have to look towards lodging a claim for damages herself.

The time limit for making a claim for vehicle loss / repairs
( special damages ) is six years .
3 Years is an unsually long period for the claim not to have been sorted .
Have the insurers of the other party accepted liability or is that still an issue?

If it is not settled before the six years is up , then proceedings will need to be issued to protect against Limitation .



For injury ( General damages ) 3 years .

If your friend intends making a claim for injury and other losses associated with an injury ; then In order to protect against Limitation - your friend needs to make his/her claim against the other party/insurer and issue proceedings before the three years is up .
