Equal pay compensation.

My local council is paying compensation to school staff who claimed under Equal pay for long term underpayment. The payments vary between �100 and �7000 to staff.
However, voluntary aided and foundation school staff are excluded can anyone advise why?

Can we take the Governors to a tribunal?
It appears that if you are employed in a voluntary aided (VA) school you are excluded from any entitlement to compensation is that not a form of discrimination ?
Surely the Law on Equal Pay applies for everyone to adhere to not just the Local Authority.
