Can I claim off Trader?

I bought a Renault Megane 1.6 auto 03 plate last week. Went to see it at a reputable dealer (not a main dealer) and they said car hadn't been prepared yet as it hadn't been there long (but I saw it on the website at least 2 weeks prior). They said I could either have the car the same day for �400 off asking price or at the asking price after 3 days when they would mot and service it if it was due. The car has an MOT till Nov and after test driving it, the salesman talked us into buying it. He made us a sign a piece of paper saying 'sold as scrap, no warranty given or implied'. We questioned this but he assured us that they knew what the were buying and the car was fine, he just had to put that to cover himself for the discount he was giving. Anyway. on the way home the engine light came on and the service light. Also the car has started missing. Do I have any comeback or is it my own stupid fault for signing that statement?!

How much was the car?

I presume that it was priced at a value that would not 'reasonably' be classed as 'scrap value' (by an independent person or judge)

By getting you to sign the statement, he is trying to get out of his obligations to you.

It is definitely worth pursuing as I am fairly sure that the only people who don't have to offer a warranty are auction houses.

First pursue it with the garage, and if they are not sympathetic then take legal advice. (CAB if you don't know a good solicitor)

forgot to say - print out a copy of the autotrader this shows that they are selling the vehicle and not scrapping it.

Thanks for your advice. The car was listed for �3950 and we bought it for �3550.

Rollo - If you read the full post, you will realise that I have not implied I was forced to do anything - you've taken that 1 phrase out of context. If you have nothing helpful to advise, then don't waste your own time or mine by adding silly comments.

It's not taken out of context - it's in the context of your posting.

ignore the idiots 'answers' as some people love to criticise and make no constructive comments.

Anyway, in my opinion, that amount is too high an amount for it to be considered 'scrap value' and he could not sell it as 'trade' (one of the other tricks car dealers try) as you are obviously not a car dealer.

I would suggest that you have a good case. Most importantly, don't try and go in all guns blazing.

Point out to them (very politely) that you want the problems sorting out. If they say that you bought it as a ;scrap car' ask them if it is their professional opinion that you paid a fair scrap value for it.

Thank you for your help with this and I have also spoken to consumer direct who have told me irrelevant of what I have or haven't signed, the dealer need to repair or refund under the Sale of Goods Act. Therefore I have spoken to the dealer and they are calling me back once they decided which option they want to go with, thank God. Looks like I will get it sorted hopefully.
