my ex partner assualted me in march by punchin me in the face the police took photos of my injuries and i have my friend as a witness, he is due up in court on the 7th of september were havin a trial cos hes pleaded not guilty he has been arrested 5 times for contactin me and brakin his bail conditions on friday he rung me and i recorded it as he made threats to kill me. they have had a bad character reference hearin were they are bringin up all his other convictions for the past 5 years as hes always been violent to me does anyone know what he will get in court or an idea he still hasnt been arrested for threatenin to kill me can anyone help??

He may have pleaded not guilty now, but if you and your witness turn up at the court his brief will advise him to plead guilty and he'll get a community service term and a few hundred quid fine.

It seems like a s.39 assault, but due to his previous convictions the Magistrates may commit it to the Crown Court if he pleads guilty or is found guilty during a trial. This is due to his previous violent nature - if it is recent.

A Community Order is unlikely if he's been on other Orders in the past and committed similiar further offences. He may be facing a custodial sentence. If heard at Magistrates there powers are limited to 6 months custodial, if case is committed to Crown, the Judge's powers are greater.

hes been charged with battery and its goin to magistrates court his other convictions are gbh on me and my sister, criminal damage numerous times also last july he was charged with criminal damage for drivin his van through my back garden fence while me and my 3 children also friends were in the garden he crushed the childrens trampoline against my brick shed, hes got more convictions than that for what hes done to me but if i was to put them on here id be here all day. His criminal record goes back to 1989 which includes assaultin police, abh, gbh, criminal damage druken dissordly, drivin whilst band, drinkin and drivin the list is endless, he has also started threatenin my family i have 2 children to him who we have just gone through court cos he was fightin to see them hes got supervised access in a contact centre an hr a wk i have to have a social worker cos of his violence anyway u get the picture wat hes like!!
