CICB and Damages

My stepson has been awarded £5500 from the Criminal injuries Comp Board for injuries sustained in an unprovoked assault. The case has not yet been heard in court.
Can anyone advise whether this money is regardless of the outcome of the hearing, and, (in the event of the defendant being found guilty) if he is awarded damages will this amount be deducted?

They must have evidence that it was an unprovoked attack to award him damages. So yes, it should be regardless.

My Dad got awarded damages before the final case and that was on police reports alone.

Yes, because the compensation is paid because the Board is satisfied that your stepson is the victim of crime committed by somebody. It may even be that the defendant didn't commit it, but somebody certainly did !
