He was mooning at his friend, so he obviously saw him, but didn't see a parade passing by ? If he had thought for one second, he would have realised the people in the parade would think he's doing it to them.
however a prison sentence is too much, an apology,which he has already done, and a donation to the British legion is all that's necessary.
