Martina was traveling home on the last train following a night at the university’s “Battle of the Bands.’ She was nervous getting into the carriage as there were no other passengers. She did not like to travel alone since being mugged just before the summer break. Jake got onto the train and started to speak to her. He was drunk and unsteady on his feet. He started to talk about his forthcoming ‘stag’ night and how he wondered if he was making the right decision. Jake realised he was unsteady and might bump into Martina. Unfortunately he fell against her when the train pulled out from the station. Although he tried to apologise he was incoherent and Martina believed she was about to be attacked. She jumped out of the train falling onto a grassy bank. Martina suffered a broken arm and her leg was broken in two places.
