How can I tell if a "New" Nintendo DS game I bought on ebay is counterfeit or not?

The game was sealed, it plays but does not SAVE?

Are there any markings I could look for either on the game chip itself or on the case. The instruction booklet looks like a real one, but the pictures seem to be a bit "fuzzy".

Not sure if I'm doing something wrong, but the b-l-o-o-d-y thing will not save & its driving me mad.

I would have thought if it were a dodgy game, it would not play at all?
