Threat of being sacked

My son is a student who works part time serving breakfast for a national pub chain. He has been employed with them for about 9 months. He called me today saying that he has to produce a passport to prove he is from the UK (he does not have his own - student skint all the time) They have told him if he does not show progress towards getting one next week they will suspend him until he gets one, then if not after a few weeks he will be fired. Can they do this, he has a birth certificate, a photographic provisional licence, bank statements for our address. Please note he is born and bred in Scotland like the rest of us. He just cant afford to fork out £70 for a passport. Can they sack him?

It is the law that he has to show he is legally entitled to work in Britain, if you look at the staff handbook it will list the combinations of forms of ID that are acceptable. usually it is a passport, but other combinations can be used.

for ID purposes it's the same as a full license.

Combination documentation:

P45, P60, NI number card or letter from an approved Government agency. (Please note that a National Insurance number does not automatically indicate that the individual is eligible to work, and is not sufficient evidence), plus:

Full UK, Channel Islands, Isle of Man or Irish birth certificate, or

Full UK, Channel Islands, Isle of Man or Irish adoption certificate, or
They should be agreable to accepting the combination of documents under the terms of employment. I have done this for my past emploees and the HR dept were quite accepting of them.

Thank you all for you help and advice, it has been greatly appreciated, i have since looked out a P45 and his birth certificate, hopefully they should be happy with that.
