Would much appreciate anyones help on this.....My neighbour uses her garage as a utiliy room. Her boiler flume points out into my garden. Whenever i am in my garden and the fan is blowing, i breathe in quite strong fumes. The severity of the smell depends on the wind but my garden is very small and i dont have the option of moving away from it. The fan is only about 6.5 ft high and just higher than my garden fence with hardly any gap between. Is this allowed? Please help?

Perhaps get in touch with the environmental department of your local authority for advice? Poor you, sounds awful - have no idea whether or not it's legal though but I'm sure they could tell you - or maybe the Citizen's advice Bureau.
How far is the flue exist from the BOUNDARY of the property between the two houses - that's the only legislation that covers this. Unless the boiler isn't burning properly so as to create a statutory nuisance (unlikely).
Or rather than going down the Environmental Health/legal boundary route - have you explained the problem to your neighbour and asked if she could perhaps get the flume moved? I'm sure a plumber would be able to do this without too much difficulty - and you don't necessarily want to cause problems with your neighbours over something that can be resolved with a bit of common sense on both sides.
