Removal of an Executor of Estate for non compliance
My Grandmother assigned an executor of estate 20 years ago. He still has the home I live in in his name. He does not file yearly asset reports. He rarely communicates with me, the only child and beneficiary. Question. I would like to remove him totally and have the home put into my name and file a complaint.

If you were the sole beneficiary, how come the house is in his name????
If I were you I would contact a solicitor now and get him to sort out the problem otherwise the current executor could finish up with your home.

Wak, it may be that the will established a trust for an infant beneficiary. It is common to provide that the beneficiary shall not inherit the capital of the estate until they reach a certain age, typically 25 or 30. In the meantime, they receive the income ( or a suitable part of it, the rest being reinvested ). There are many possibilities as to what is,or may be, provided for the beneficiary to meet his or her needs until they get the capital, but those are basic. If the executor was the trustee for this purpose and the infant LAHMAH very young at the death of the testatrix, it's quite possible for 20 or more years to pass before the capital e.g the house is transferred to the beneficiary by the trustee.

I am 59 yo. The home is to be sold upon my death. Split to my children. My main concern is the millions of dollars he was to allocate to me until my death. My payments stopped at the 20 year mark. Executor stating the money gone. I never received an asset listing and the city records stated he didnt file them. Now he is no longer an attorney, lost his business and I feel the need to remove him for negligence and to have the home put into my name. Thanks for such great response.
