Full story below! I need help - how I can get parental responsibility removed from my ex. I want to change their names to their knownas name of last 6 years. I also need to know he wont get custody if I die among other things that his permission is needed

I had a daughter then got married to her father and had my second daughter. He was violent and after we divorced (2000). I stopped contact following advice from Social Services after my eldest made disturbing accusations and the violence towards me continued (2002) When girls were 2 and 4. I remarried my husband (who has been the childrens Dad) and my ex took me to court for contact. The crown court could not make the application until the girls had been assessed by a shrink, who reported the fear myself and kids had was real, my ex and his new partner were ordered to attend parent classes and the court ordered on completion that there would be 6 mths of initial supervised contact via a contact centre - this did not go well so court revoked the order.

He then took the children to court for contact and the court appointed a Cafcass officer as gardian, who again assessed the childrens behaviour when discussing their Father. There was then indirect contact at my authorisation and they read the children letters once every three months. During the court cases I suffered 2 still births - each time going into labour the day of attending court and facing my ex, although I could not prove it was related to stress, the court ordered a 2 year

Sorry - It cut off the rest - I probably ran out of space!

The order was for a 2 year break, during which time I agreed to qtrly updates communicated via cafcass. It is now the end of the 2 years and cafcass has reported the children clearly do not want to start a relationship with his and he has since withdrawn his application for contact.

Given the fact that the court had over 7 years not granted him contact and he has since withdrawn from the case - I do not think it is appropriate he has parental responsibility. He gets legal aid and has happily taken me to court for everything, so I am sure if I contact him requesting permissions i.e. passport renewals/change of name he is going to not be nice about it and we will end up back in court. I am sick of feeling scared of provoking him still now after 8 years of being 200 miles away from him!

Thank you for taking the time to read - I am still paying court fees and barrister costs and my solicitor has put my account on "hold" until I pay the last £4,000 out of thousands I pay each year, so at the moment they wont advise me and I cant afford a new solicitor while still paying the previous - so any advice is greatly appreciated.
If your financial position has now deteriorated that much, you may now qualify for Legal Aid yourself perhaps...?

My suggestion is to contact a Legal Aid Lawyer and apply for assistance. With the greatest of respect to you and your children, I dont think online forums like this are your best medium for advice of this level of seriousness.

Also, keep good friends and family close, you need good strong emotional support around you as well.

Take care and good luck
