What are the rules for giving notice on a month to month tenancy; an assured tenancy of six months which has been allowed to run on for about 10 months after the fixed term expired? If the landlord gives notice what period must he give and when does it run from? Likewise if the tenant gives notice what period does he give and from when? Does it make any difference if the tenant is in breach of some covenant in the original agreement and the landlord wants him out?
If the landlord wants the tenant out for some breach of covenant he normally has to take Court action. This would take much longer & cost money so no point doing it.
