Executor and beneficiary hands over probate etc to a solicitor. There are 2 other beneficiaries. A challenge is made on the will by another party. The other beneficiaries use a second solicitor to represent them. The executor/beneficiary stays with the solicitor to represent them who use a barrister. The case is settled out of court. The executor had £15k barrister bills set against the estate whilst the other beneficiaries are to fund theirs from the shared inheritance. Should the executor have been allowed to use the same solicitor to do probate and represent them as beneficiary? Is there conflict here as executor is supposed to be impartial. Any thoughts please?
