I would think you will be charged with being unfit through drink, in charge of a motor vehicle.

Only if you can satisfy the court that there was no possibility of you driving the vehicle while your blood-alcohol level was above the legal limit, (for which purpose any damage to the vehicle which prevents it from being driven is to be disregarded)

Can I ask why you were sat in the vehicle drunk if you didn't plan on driving? Just seems a bit odd thats all! In answer to the question then no you won't get away with it. I know someone who got done for drink driving and went on a course, he was told of people who had been charged just for having the car keys in their hand when they were only getting something that was previously left in the vehicle.

sitting in the driving seat, keys in the ignition, no chance whatsoever of getting away with that, your only chance will be your plea i.e. I need to drive for my job.expect a heavy fine and a ban and when you get the license back your insurance will be sky high.
Always remember a cab home when intoxicated, even if its £50 is a lot cheaper than paying for a year's cabs when banned.Sorry to be so negative but I think you already know the answer.
