Suspending payments under a consent order

My ex wife and I signed Consent Order but I have now lost my job and have no income. Can I suspend payments and how do I do this?

For more on marking an answer as the "Best Answer", please visit our FAQ.I assume this is a consent order made in divorce proceedings. Either party can apply to the court at any time for variation of a periodic payments order whenever there is a significant change of circumstances.
Youi will need to make application to the court on the appropriate form (which the Court office will give to you) and set out in an affidavit what your circumstances were when the order was made, and what the are now. There will be a hearing (or hearings) before the District Judge who will decide what is to be done. Of course you should first try to explain the situation to your ex and get such an order made by consent. If you just stop paying you will remain liable under the order amd she could claim the arrears later on.
