My manager has applied for a job with another company and I have been sent a questionaire about him by somebody I know at that company.
.
The person has given me a signed letter on company paper stating ''We hereby give you our undertaking that the existance of this questionaire and anything you say in this questionaire will remain confidential between yourself and ourselves.

Is this legally binding and would I have any recourse to the company if the management of my company finds out about this questionaire.

As Dotty says you can only give a personal reference, myself I would ignore it. I dont know how you get on with your manager but what if you say something unpleasant and he doesnt get the job?

I'd be careful about saying anything you wouldn't be happy to say publicly. However much the company promise to maintain confidentiality, the person in question is likley to have rights to see what info is being collected or held about him/her.
Don't complete it if you don't want to.
I agree with Maidup.
if it was me I would throw it away.
what goes around comes around - so keep your options open
well if you're putting anything bad then you dont like them so best to put something good so they get the job
You have no authority to give any business reference based on your working relationship with your manager, it would be gross misconduct to do that, however, you can give a personal reference but only with the knowledge and consent of your manager asnd you MUST NOT mention anything to do with your work relationship, so good luck with that
I'd tell the company that their letter contained quite a few spelling and grammatical errors.
I'd also check with your manager that he is happy for you to provide this information.
I have never heard of this situation.

Where did the co' get your add from? to send you the questionair. did your manager give it to them him thinking you would put in a good word?
It is not compulsary for you to fill it in.
I think if I were you I'd ignore it, Keep well out of it.It will only cause you stress and maybe sleepless nights. BIN it.

I would be inclined to tell the company concerned that you are quite happy to fill in a questionnaire/reference with your manager`s permission. Otherwise I would steer clear of getting involved with a company that is prepared to behave in such an underhand way.

I agree with 4get, if you dont like him say nice things and he'll get the job and leave..
This happened to me a few years ago and I asked our Human Resources department if I could answer it.
They said as there was nothing in my contract to prohibit me from answering it the company could not take any action against me if I answered it as long as I answered in my own personal capacity.
