Hi can anyone help me? I live in the middle of a row of terraced houses with a back garden and front porchway. Do you know which side (left or right) from the back of my house that I have border responsibility for? The reason I ask is my neighbours to the left have just moved and taken the garden fence with them!! Seriously!!! Only, the new tenants are moving in this weekend and I am now told I an responsible for replacing the fence?
It should say on your deeds, but as far as I am aware there is no legal onus to have a garden fence, unless it's to keep dogs away from your neighbour's property.
If you are responsible for the fence then technically the fence belongs to you and your neighbours shouldn't have taken it. It seems very bizzare. I wonder if they put the fence up because the person who lived in the house before you wouldn't see to it and they are taking it on principle. As craft as already mentioned it will tell you on your house deeds.
Thank you for your replies! We have met the new tenants this evening and they have told us she has also taken the aerial from the roof and the padlock from the back gate!!!!!! The new tenants had already been told of her plans to take the fence so had already planned to erect a new one but she had told us both we were reponsible for it so we've agreed to go halves! Seems I now have some sane neighbours so half a fence is a small price to pay :)
I hear your old neighbours have done this before. They took a wall, a chimney and asked for three other fences to be taken into consideration when caught....sorry!
Sistermag, you need to check your deeds - they will show which fence belongs to you. It's not always right or left, mine is on the right as I stand at the back door but the end one is mine, too.
Thanks boxtops I am going to check tomorrow for arguments sake but as I've now met the new neighbours and they seem lovely I think splitting the cost is fair! I was just a bit shocked when I came home and found she'd taken it as it doesn't seem a very normal thing to do!!!! It's provided quite a giggle for us all though!! We've been thinking about leaving it down and having a nice party for the royal wedding in our new extra large garden haha!!!
