Diferent size Spare Wheel

I have a one year old Renault Megane, with 17" alloys. (Renault fitment). When I had to change a flat tyre and fit the spare it turns out that it is 16" and not marked "emergency use only", surely its not legal to have tyres of a different nominal size on the same axle . Checked with Renault dealer and he showed me two other cars the same !

Alot of the new cars have space saver spares. You are only supposed to do a maximum of 50mph on these tyres. Not like the person I saw in a BMW who was doing near to 90mph!
