What constitutes a gift a motorcycle in theis case
9 Answers
My ex girlfriend bought me a motorcycle when she went to buy one for herself but couldnt find the one she wanted.
She asked me which bike i wanted, and paid the deposit on it on her own credit card. The following day we range my insurers and the bike was insured on a policy in my name with me being the owner and registered keeper and as private use only excluding all business uses, specificall hiring.
Two or three days later we took my daughter and went to collectmy new bike from the dealership where the log book v5 was put in my name i was given all the documents and all three sets of keys. Over the next 4 months all my fr4iends and family were told she had bought the bike for me and she told both my ex wife and my eldest daughter she had bought the bike for me as a gift Now I have received a letter from a solicitor saying she has stated the balance of the bike was paid for from her company account, that she had told me that it was her company's bike and that she never inteded for it to be given to me as agift only that i was to be allowed to ride it , What proves it is my bike?

because it's your name on the log book etc. i do think you have a strong case to claim that it's yours. tell her to get stuffed and if she wants it, then she'll have to drag you through the courts for it. this may well just make her think twice (due to cost, effort etc.) and you have nothing to lose - except possibly the bike if you lose. i wouldn't lose any sleep over it! x
