Can anyone help me? I have 2 children to my former wife, they are 9 and 11. We were married at the time of birth of both children and I am on both birth certificates therefore I understand that I have perental responsibility. I currently live in the south coast of England and we have been split up since 2003, however due to the distance I only see the children 2 or 3 times a year but I do ring them at least once a week. Recently she told me she does not want the children and could they live with me. On speaking to the children they are not happy with their mother as she is drinking too much and neglecting their needs. The social services are now involved. I am in the forces and due to go to afghanistan for 6 months next week. Were do I stand on obtaining custody of the children if she does or does not want this to happen? Do I need a sSottish solicitor to deal with this problem as Scotish law is slightly different? I love my child and want them to grow up happy and I am frustrated with the situation. I would be greatful for any response to my problem, many thanks.

See a solicitor and for gods sake make sure they are good, don't just take their word for it. English and Welsh law is different from Scottish law, but you must move on this ASAP. Take it from someone with experience in this and GET A BRIEF asap.
