hello i have just bailed for a section 18, i was in my local pub on a tuesday night having a drink with a mate and a local idiot who was celebrating his birthday and was very drunk was winding me up over the course of three hours it began by him messing my hair up as he walked past then he clipped me round the back of the head twenty minutes later and then leaned forward in my face and blew smoke in my face, each time i warned him to leave me alone and as the night went on i began to get drunk, then the bloke went inside the pub and returned to laugh at me and once again blow smoke in my face and as he did i snapped, the un fortunate thing was that i had my drink in my hand at the time and ended up glassing him, he suffered fairly bad lacerations to his face and has pressed charges there was no witness statements and i answered no comment in my interview, i didnt pick the glass up to use as a weapon it was just in my hand at the time. I have previous for abh but havnt been in trouble for three years i have a good job and a child to support, would anyone be able to tell me there views on what my sentence could be. thanks

you have 2 hands... one was presumably empty... stating you didnt pick it up on purpose is irrelevant...
sorry don't know about sentence (chris will hopefully be along later as he usually answers these sort of questions) Anyway, are you going to plead guilty? Have you got legal rep?

Have a read of the attached document. Sec 18 GBH, start at page 3. when you say you have been bailed for a Sec 18 assault, have you been 'charged' with Sec 18 and bailed to appear at court?.

(Out of interest, why did you answer no-comment during police interviews, was this on advice of a solicitor).
When I am a juror and the evidence is shown and the accused says 'no comment' I always vote guilty.
Heavy I'm afraid. Similar offence committed before and the use of a weapon. The sensible thing to do would have been to have left the situation without retaliating and gone somewhere else for the evening. You snapped and have to suffer the consequences.

i have not yet been charged, iv been bailed until november pending investigation there are no witness statements so im not sure what evidence there is to support the case apart from his word against mine, i totally understand this behaviour isnt acceptable and its not something i would usually ever do
