Chances of imprisonment?

Hi my partner has been charged with 2 counts of assault by beating,we had a fight.My brother overheard us over the phone and when the phone went dead as i threw it he called the police.My partner was on a conditional discharge for assault and battery.both my brother and i retracted statements.witness summons have been served but we have not been given them as yet.I do not wish to give evidence against him.Our relationship as been riddled with financial problems and we are both as bad as each other when it comes to lashing out.What can I do to prevent him from going to prison?we would both end up homeless,and he would lose his job he has had for years.Should I write to the court for the case date?If so what do you suggest I say? hi, after the news today regarding the notts police, i would think the police will persue it whether you retract your statement or not

Hi Mark,Indeed the cps are still prosecuting,I was wandering though whether I could help with addressing the court,whilst he is in court with a letter to lessen the chance of a custodial..what happened with notts police?x

sorry just read the news,I am all for action taken against domestic abuse however not all cases are as black and white as this one.

hiya, my name is not mark - i think you are readign the "mark as best answer"line :)
the notts police were severely reprimanded because a woman accused her b/f of domestic violence and they didn't do very much (8 incidents i believe) and then he killed her. The CPS have a policy of persuing dv cases even if the victim withdraws the statement because of this very reason. The think (and who wouldn't?) that the victim has been intimidated into withdrawing

You made the statement then retracted it - I am not sure that the police won't still proceed. Domestic violence is not treated lightly and your partner already has form.

do you see yourself staying with this guy for a long time? if you do i would suggest you take some self-defence classes. I don't think there is anything you can do to prevent him being prosecuted though - you and your brother both gave statements,and there will of course be the police report. the prosecution will go ahead for your own protection - you never know how far domestic violence will go - and i know you say that your both as bad as eachother, but that really doesn't sound like a happy stable relationship.. sorry
