my boyfriend has been charged with a section 20 wounding he was on licence till 2015 over another charge a few years ago!

he came out of prison last november and was put on licence till 2015,in august he was arrested for an alledged assault..he got recalled back to prison and is due in court nov 30th,hes going not guilty but ive heard off solicitors that even if he is found not guilty he could still do the rest of his licence till 2015,y is this,its just one lads word against my fella,no cctv or anything,what will happen,its really stressing me out!any help would be appreciated..thx

Sorry, I'm not sure I understand the issue. if he was already on licence until 2015 then if he is found not guilty his licence will continue to run until 2015, so he will be no worse off than before

he was let out on early release after doing 2 1/2 years in prison last november,he was on probation licence,sorry i mean he could stay in prison till 2015 even if hes not guilty..sorry tired n stressed.

Thanks. I don't know the rules then for such licences but, although it may sound unfair, maybe if he is the sort of person that tends to get into assault situations the authorities will decide he is better off in prison. Or maybe he has already breached his licence in some way- where and how did the latest alleged assault occur?

As Eddie says, he can be recalled simply for being arrested. No doubt the Parole Board will take all the circumstances into account in deciding whether to operate the recall.
