my sister was killed in a murder suicide - her husband killed her then himself - his family went to the home mysister and her husband shared and ransacked the house. My mom has legal custody of the kids sould every thing go to the kids.

(A) was there a will

and

(B) you don't say where this happened which will probably have some bearing on the answer. By your spelling of mom, seemingly the states, and this is primarily - though not exclusively - a UK site, so advice may be irrelevant.

Regarding who gets the estate, I don't see the relevance of the bit about his family ransacking the house
I'm guessing that the poster means that his family ransacked the house and took items that possibly should have gone to his kids?

Ah, sorry , you will be right, cheekychops. Perhaps because it was all one sentence I'd assumed the ransacking occurred at almost the time as the deaths or as the bodies were discovered

If it is in the UK, the man's family will have no right to the estate under the doctrine of forfeiture since he killed her.
