Who's to blame?

I had someone go into my rear driver side door and they've written off my car. I was on the centre line of the main road with my handbrake on as I was waiting to cross the road. There was a lorry parked on zebra crossing zig zags further down the road. The other driver overtook the lorry on the zig zags and ploughed straight into me. Whos legally to blame?

how did they manage to hit the rear side of the car if they were overtaking before you?

anyway, give all details, photos, witness details etc to your insurers for them to sort, thats what you pay them for.

so you were waiting to turn right and the lorry was parked between you and the other car? how did it hit you then?

He/she is. You were stationary the law says even if you are illegaly parked that if you hit a stationary vehicle you are to blame.

Well assuming there is a give way line where you were waiting I'd say you should be giving way to the traffic going across you so it's your fault for being there.

She has made a claim against me. She had one damaged headlight, her cars been valued at £45, mine is £4000 and is written off. Im not a Happy bunny!

were you all travelling in the same direction?

do you mean that the car could not see that there was space in front of the lorry they were overtaking, but overtook anyway...and pulled into what they thought would be an empty space but wasnt...?

are you tallink about a cross roads where there is one road that goes perpendicular straight across the road you are on. ie did tou cross a give way line? or did the preson that hit you cross a give way line? Can you give us a google of the junction and indicate your position, thanks.
