An alternate scenario.

Two OAPs Crossing the road, one has had a drink. They don't see a car, and it hits them both. Does the TeeTotaller get free treatment, and the one who has had a drink have to pay?
20 points each for hitting an oap. Good score for the driver.
Seriously though, id say if drivers responsible they pay.
The driver was an OAP in a SmartCar...............
Can smart cars run over 2 people? Arent they like a corned beef tin with wheels?
