Serious Q re resodence order/PSO.

My son's father lives hours away from us and rarely sees him. He is an awful man, has lots of issues, has caused us no end of distress and doesnt work. To cut a long story short things came to a head several years and I finally applied to the court for a residence order . I had never gone down the court route but my sons headmaster pointed out that if the father just turned up at the school to take my son then they wouldnt be able to stop him if i didnt have the residence order, as father was threatening to do just this. So I went to court and ex didnt turn up. I was then granted what I THOUGHT was a residence and prohibited steps order. Father then contacts son on FB this week saying he is going to come and get him so he can live with him. I dig out my order and it says INTERIM residence and PSO. So can he now just come and pick him up and I cant stop him??

An interim residence order is usually made immediately and lasts until the court makes the full order, you do not give any details of dates and there can be some time between the interim and full residence order. If it is just that the court has not yet made the full order, and you have then prohibited steps order and the interim order this will suffice. As you will have discovered the court will always take the action it considers to be the child’s best interest as being paramount.

Hi Tony, this was several years ago that the interim was granted. Ex didnt turn up to court and I then recieveed the interim order in post. Never heard anything from court again and tbh I had forgotten all about it. So do you suggest I contact the court again?

He is 12. Wont have a word said against his dad(understandably) but has got to the age when he realises that his dad is acting very irrationally and has questioned me about him.

Yes smowball if the iterim order was granted some years ago contact the court again or if you used a solicitor ask him too, the courts can be slow but they are not that slow.
