insurance claim

My property is council owned however l had a water leak from old tank and have put a claim in to the council due to the fact they should of replaced this in 2005 they are saying l have to make a claim against my own home contents insurance (Which l do not have) as they are will only paid a max of £50. Should they have insurance cover to cover for damage done by them? As if l had home insurance would they pay out for damage done from outside workers?
