we was took to court last year for not paying rent in private let property we went to court willing to pay although details they provided were not correct they did not turn up for the hearing and it was thrown out of court now we have had a letter from another court to say we didnt obey judge and pay the money and could be sent to prison if we dont fill form in they sent us its only in my name and it was in joint names and it as not got my name right can anyone put any light on this matter please

I can't follow your thread as it doesn't make sense. If you agree that you owe the money then one suggestion is to start repaying it. They will get the details right eventually

not really - no punctuation; who are 'they'?; who originally took you to court?; why didn't you originally pay?; how different was your offer to the amount owed?; what details were and are incorrect?; what sort of paperwork have you been sent?; why a different court?; how long has this been going on (i.e. a time frame)?

zac1...Go to the Citizens Advice and speak to someone. Take your form and any other papers with you and ask them for help. If you speak to them face to face you can answer any questions they have.

I agree the post is so confused it is difficult to understand. However, a rent debt is a civil matter, not a criminal one, so there can be no question of prison unless something else has happened which has not been stated.

I think what might have happened is that John Smith owed the rent and was sued as Jean Smith
I think some parties didnt turn up perhaps also John Smith who might have been told he didnt have to
(would you answer someone else's sumons ?)
because it sounds as tho there was no application to have the case dismissed
(which if I had turned up I would certainly have applied for)

and then and then suddently they find John SMith that is, he findsthat there is a CCJ default judgement against him
perhaps aargh even in JOhn SMith's name !

PP - I think you're speculating! If (& it seems to be a big IF) "it was thrown out of court" as the OP said, then it was dismissed - not left in limbo. The Court doesn't just leave it hanging in the air - they either make a judgement for the claimant or dismiss it (i.e. find for the defendant), or adjourn. Just part of the inconsistency of the OP.
