I do not understand the question.
Que ?
yes
Er, possibly
I think that what the questioner is asking is that if he has a dishonoured cheque, what is the latest date by which he must take legal action before being time-barred.
Thanks for explaining Mike.
The limitations act should not be considered if you have a dishonoured cheque. If it is under £750 you can issue a statutory demand, which does not have to be issued by the court, and if not paid within 21 days the creditor can issue a creditor’s petition and apply to the court to make a bankruptcy order. If the cheque is for over £750 and the person appears unable to pay the creditor can apply to have the person made bankrupt.
