...even in a case of rape. The child was an innocent party, she said, and the mother could give it up for adoption or even keep it.
Her remarks prompted this thought. If the rapist was arrested and punished for his crime could he then go to the courts to enforce his right to access to his child?

no....it's happening here as well....i read about a case in the paper the other day. i don't think the rapist should have any rights, and the woman should have all the right in the world to make up her mind - not some male orientated plutocratic establishment.

Could the mother sue the legislature for mental cruelty? I would imagine carrying an unwanted child for 9 months would drive some mad.
Even biological parents who conceived legally as it were have problems accessing offspring once they have been placed for adoption.

So no, I do not think any court would be likely to uphold such a request.
