Care worker attacked in nursing home.

If a care worker is attacked in a nursing home with mentally ill patients , and receives a broken nose , is there an organization of some sort to claim damages ??

do you mean is there a fund that pays out compensation? Or do you actually want to sue someone (the patient or the home)?

Someone i know had her nose broken by a care home resident , wondered if theres any protection for care workers like the care home being insured for such things ?

I know such things are common but do not think there is a 'claim fund' though.
As far as I know , and i have worked in a carehome , the care homes insurance will have to sort it out.
Some patients are known to be dangerous and have a 'risk assesment' written for them. The care home I worked in had one lady who had to always have 2 care workers to attend to her, as she was known to bite anyone who upset her , and she was very easy to upset.

Thanks for that , don't seem right that a care worker on minimum wage should have to work in sometimes dangerous areas like this without any sort of insurance . I 'll get her to find out.

If there was negligence on behalf of the care home which led to the accident, then the care home's employers liability insurance company should be approached.

It would be helpful to hear from one of the ABers who works in this sort of setting, to know what the arrangements are in their homes.

I'm not sure insurance is relevant here.

If the care home failed to supply you with a reasonably safe working environment (including training on procedures) then they are liable to you regardless of whether they have insurance or not.

If you failed to follow such procedures then that's likely to let them off the hook.

And there is of course a grey area in between.

dzug, every employer has to have EL insurance, it's the law - in the event of negligence on their part, as you describe.
