A relative was recently involved in an accident when he injured a colleague whilst operating a fork lift truck. Within minutes he was asked to give a statement about what happened. He was in shock and upset at the time but signed it. He now wants to withdraw that statement and give a more detailed version. Will he be allowed to do this, as he considers that he should have been allowed more time, due to him being in shock and distressed? Any help appreciated. Thanks.

If there is a claim for an accident in work the defendant will be the employer of the injured party. If your relative wishes to add too or make a new statement this should be permitted, but they should be ready to explain why this was necessary at some time in the future. If it was your relative who was injured they may wish to take legal advice.
There should be a statement in the firm's accident book (this is a Health & Safety requirement) which will one of the statements relied upon if an employers' liability claim is forthcoming. Who did he make the statement to? I would have hoped that a supplementary statement (giving the reasons why it's being made) would have been allowed.
