Hi, I moved into a house share about 3 months ago and my landlord knew that I would be claiming housing benefits until I get a job. he agreed, and I moved in. he didnt give me a signed contract straight away, he took the only copy with him. It took me 1 month to get a copy from him and now the housing need him to fill in a declaration form but hes ignoring my texts and phone calls. ive tried for so long to get this information from him but hes being a complete tool! ive had to borrow money to pay my rent up to date so I dont get kicked out...but this month I just cant get any more money together. Is he able to kick me out If i cant pay him, but its his doing? how do I get him to sort things out for me?

As you correctly say housing benefit will only pay for accommodation no other costs and the declaration you mention is not used in every local authority.
Your landlord is required to provide you with written terms of your tenancy under S 20A of the Housing act 1988 if you are waiting for a declaration to be signed make your claim for Housing and Council Tax benefit now and submit any additional information later. If you have made a claim for JSA the DWP may have been in contact with your local authority to whom you should explain your position, the HB may be paid direct to you and you may need it to be backdated, do not delay.
