when emerging at give way crossroads and someone is directly opposite, im going straight ahead and they are turning right who has priority

They have priority because you are crossings the road they are turning into. In this situation, I always wave the person across, just to make sure.

Yes, if everyone has to give way (and there are no STOP signs) then I'd say he is making one manouevre turning from road 1 to road 2, whereas you are making two: from road 3 into road 2 then road 1.
But maybe it also depends who was there first and who started to move first .

Always worth remembering this one:-

In other words, no-one has right of way. You use your common sense.

Baldric's link is good and suggests I was wrong- the driver going straight on seems to have right of way unless the road opposite is blocked.
But I think it does depend on whether it is an exact cross at the crossroads or whether it's staggered slightly.

Common sense.Straight on has right of way because you are not turning into anyones path.

Whatever the correct answer, you can bet your bottom dollar tHe other driver what know who has the right of way either. Best to give way and wave him/her on.

If the incident has happened and resulted in a collision, then leave it to the insurance companies to figure it out.

I cannot imagine how anybody turning right in the path of oncoming traffic would have the right of way (unless road markings or signs make that specific provision at an individual junction).

There's a demonstration of this situation on the driving theory test's website. It shows that the car going straight ahead does indeed have priority. But there's obviously an awareness that the other driver may not know of this rule when they add, 'However, do not assume that the other driver will comply'. Scroll down to 'Priorities'...

If it was a roundabout you would give way to traffic approaching from the right - surely the other driver has right of way if theyre turning right?

No, Krf. At a 'Give Way' crossroads junction you should give way to traffic approaching on the road both to your left and to your right, not traffic approaching from the road in front of you.
