Crb Reimbursement

I got a job in a care home in February & had to wait for a CRB check before I could start (which took 5 weeks to arrive). During that time I was offered another job which was more beneficial to me and I could start straight away.

I contacted the care home to inform them that I would no longer be taking their position.

In March I received a letter stating that "the company will pay for a CRB disclosure on the condition that you successfully complete a probationary period. If this period is not completed successfully then the fee will be reimbursed by you".

At no point in the interview was any of that mentioned and the advert quite clearly stated that the CRB would be met by the employer. No probationary period was mentioned in the interview.

I have just received a second letter requesting that I reimburse the outstanding amount without further delay.

There are no threats in the letters of of any legal action and personally I don't think they can legally make me pay as their letter states it is a request.

What you think can they make me pay as I really can't afford to.

not sure what the legal side would be but as an employer, I would be peeved as hell to have to pay for a CRB and then the employee doesn't actually start work for me.

In theory the employer may have a stronger case for action for breach of contract if you failed to give the required notice, but companies rarely bother. I doubt they'd bother trying to recover the fee here either, but it's a risk

crb checks cost £26, and enhanced ones cost £44. How much are the asking for?
