With the ever increasing pop holes in the roads & also the Motorways, if you can determin that damage to your car has been caused by potholes, would you claim or just can not be bothered.

I would if I could. Our road is disgraceful, it's been patchwork repaired so many times, each time I complain about it.

If I thought that I could prove it then I would TWR.

^ but there are criteria, same as if you fall over a raised slab in the pavement, the difference on the pavement in heights has to be an inch or equivalent. Don't know what it would be for a pothole.

If I was sure I could prove it, yes i would claim. We pay enough council tax and road fund licence for roads to be properly maintained.

If they are sufficiently bad then I do report them.

If I know they are there then I feel it is my responsibility to manoeuvre around them if safe to do so.

If I encountered a pot hole that I was not aware of and suffered a mechanical failure as a consequence then I may consider taking action. I say 'may' as in the winter the LA has plenty on their plate to be dealing with, if it was June and there was a previously notified pot hole then I would be tempted to take action if my loss had been of note.

yes i blooming would. I drive a Rav4 and a pothole deep enough to damage my car would be huge!

I don't know how people manage to prove damage was caused by a specific location but they do manage and the law states an unacceptable hole on a road and pavement. But I had a strap ripped off my petrol tank which could only have been caused by a road hump, and discovered councils also pay out thousands a year for damage they cause, on top of the £10,000 or so each hump costs you and me. So humps have fixed costs plus pretty massive variable ones which put the council taxes up for everyone for absolutely nothing, and wear out the suspension of every single car which has to suffer them on a regular basis as they were not designed for horizontal (as opposed to diagonal) movement.

I will never forgive Ken Clarke for roadbumps.
I have never reached the point of being bothered except just when going over them and then I'm inclined to forget about it.

Truthfully - I wouldn't have a clue how to assess damage and I wouldn't get out and look and I wouldn't even know if damage had been caused unless the mechanic noticed (I have never been under my car!) and then finding the bump or pothole to blame! - where would you start?
The thing is if alot of people are like this then the council dont fix them because they dont get sued. They are horrid to drive over though.

I would if I could prove it. I do email pot hole photos to council with a warning that if I know of an accident my email will be evidence against council.

NO potholes on my roads as theyre repaired within the hour ;)

There was a prog on about a guy who took his council on and won damage caused to his car by pot holes.
Some thing about the council knowing about the pot hole.and it being recorded down for repair. Which basically lets them off the hook
He requested to see the records under the freedom of info act, and found out they did not as they had stated have a record of inspection for that road/pot hole.
