My employer, of 2 years has always paid our wages through BACS on the first day of each month. However in order for the money to clear straightaway he charges �9, or he says I can wait for 3days which is my banks standard waiting time for the funds to clear. In short this means over the last 2 years I have paid over �200 just to be paid, I have bills that need paying at the beginning of the month therefore I need the money on that day. Can I claim tis back, my contract was given to me on the day I started when I was working 16 hours per week this soon increased as did my salary, therefor the contract I do have is worthless, it says i will be paid monthly.

I also Get paid via bacs transfer but so that i can receive it on the last working day of the month he always makes the transfer 3 working days before this time.

I reckon your boss pays you on the first of the month so that he will receive the extra interest on the monies in his own account. Just ask him to make the transfer early.

Alternatively just re-arrange any direct debits to be taken from your own account 3 days later.

as far as i know, although it takes 3 day to technically clear, once the money is "pending" in the system, you can use it as the bank are aware its in the system.

also, any bills you pay take 3 days too, so the money won't leave your account immediately anyway.

obviously its more compliacted than this but the banks make allowances for this kind of 'overlap' - anyone know if perhaps this isn't the case?

most bills have either an end of the month or begining of the month option, some you can specify the day

If you pay your bills by dd, they will start processing via bacs 10 days before the date they are due to come out, then they take 3/4 days to clear. So either reorganise your dd payments (but be aware once in bacs they cant be changed at all you will have to wait until payment has cleared) or consult citizens advice or a solicitor about employment law. If your contract is not up to date you are probably missing out on holiday pay etc and if you go sick it will cause you problems. I have to deal with BACS payments everyday and i dont see how he can speed your clearance of funds by charging you �9 as bacs works by transfering funds to a creditors account (Yours) from a Business Account (employer) and as the others have said is set up for a specific date. If all else fails ask him to set up his payment dates so that your money clears on the date you have been told and not 3 days later as is your legal right adn should be stated in your contract, you wouldnt expect your landlord, bank, insurance company to accept this so why should you?
