A friend of mine who is male and 29 years old has lived with his grandmother for over 15 years in a council property. She has now been taken into care as she is suffering from dimensia. He has been told that she had never actually declared him living there? and has to be out of her property by Monday of next week. surely the authorities can not do this ?? can they ??

For more on marking an answer as the "Best Answer", please visit our FAQ.Did the tenancy go to the gran when the grandad died? if it did I think that most local authorities only allow the tenancy to be passed on once . ie from husband to wife or visa versa ,he really needs to go to citizens advice or have a cosultation with local solicitor, if there is a chance she may come home I don't see how they can take her home away,but see somebody quickly.
One bit of evidence that will definitely confirm whether she declared him there or not is the Council Tax assessment - you get 25% off the normal rate for just one person living in a house. Check whether the assessment for Council tax is at the reduced rate - irrespective of whether part of the bill may paid by social services on low income grounds.
i know for a fact that he wont be allowed to live there .before i bought my council house i applied for my daughter to go on rent book with me and i had declared her living here and they wouldnt allow that . if she has been claiming council tax rebate she may be in trouble for not declaring him as living there.cant quite make out if you mean the grandmother has to be out of house
