I'd say the Daily Maul has got even sillier. The rules in English Law governing the right to a fair trial and prejudicial statements pre-date human rights legislation by a few centuries.

It would be wrong for the police to be prejudicial about these things. There could a perfectly innocent explanation as why to he's wearing a black balaclava and carrying a gun at the scene of an armed robbery.
