False Allegations From Ex Partner
19 Answers
attached is cctv footage from a council camera that i obtained via west mids police professional standards.
the incident happens around 4 mins in (or should i say the alleged incident)
allegation my ex told police, she said she was driving a purple mini up the street and i were coming in opposite direction, i sped at her and without slowing or stopping and forced her off the road. Her mom also put in a similar statement with contrasting details.
she also stated she was overtaking a parked car at the time of the alleged incident.
what police report says.
police report states my ex was infact driving along the street in her purple mini, and my black toyota taxi comes in to view as she gets near the trees, my car becomes stationary behind the parked cars outside the few houses at the end of the street.
at no point did my ex swerve her car, or overtake a parked car. but wont bring her in for harassment or wasting police time as i was cleared of all wrong doing.
the story behind this footage though is that officers arrested me 9 days after the alleged offence, yet deemed my arrest necessary as it was serious offence and they feared my ex safety was in danger. 2 days after i was cleared i had day off work and looked around area for cctv cameras, only to find there was a camera in the street. i notified council to see if was working and the data protection unit advised it was working fully and i could request the footage for the fee of ten pound. I notified police officers regarding the footage but failed to take note, a few weeks later police intervened and decided to check the footage out. they said has i have wrote above but has i declared the officer didn't do her job correctly and they failed to send evidence to cps, or even get evidence and i complained they are refusing to take a statement, and there reason is as follows "the cctv footage doesn't show who was driving what car" even though there are numerous statements that match up who is in what car at what time.
I personally think its a lame excuse.
thing i'm trying to do now is get police to take a statement off me for the malicious allegations, plus take the reports and cctv footage i have and send them to cps, as cps haven't seen this footage. I are asking for help in the way of does anyone know what I have to do to get the footage looked at and a statement put forward for cps.
thanks in advance

I once sat on a jury on a case involving CCTV and it had to be VERY OBVIOUS that it was the defendants that we were seeing for the prosecution to succeed.
canary, there are several statements that say im in my car , and my ex is in here car.
even our own testaments state the people in what car, my car has an electronic data tag linked to myself.
police even admit no offence took place, and that her statement isn't true. i have the report but wont be looking at my complaint

It would be a crime to force her off the road but from the CCTV I can't see any evidence of the offence actually happening. You say you have been cleared so what do you hope to gain by this?
If you hope to sue her for a false accusation that would be a civil case, I warn you that such a case is VERY hard to prove and VERY VERY expensive with no chance of legal aid.

and the point is, that if your ex had said it was a policeman who had done the forcing off the road and so on,
they would show slightly more attention to that matter in hand....
perhaps ( or certainly )
and when the false alleger says I just did it to him into trouble, they may take it further .....
depends how much you wanna spend I think. If you have a long pocket you can pay a solicitor to make trouble.
There is a civil action called malicious falsehood
and you would have an action there ( I think ) but you have to show loss - such as loss of wages - or your employer making trouble for you as a result of the allegations.
you could also allege wasting police time
I am not sure why the police are saying it doesnt show her driving
when she had made a statement saying she was driving.... on which I would have thought you could rely.
Putting it on the internet is a good one which I notice you have done

agree ed I think you need to start and keep a harassment diary. Painful but could be of use if the 31st and 32nd allegation comes in which it doubtlessly will.
Odd that you are are arrested for breach of injunction and then let you out saying oops sorry there isnt one.
Presumably your mother in law said: " there isnt one ( an injunction ) ? - you know I could have sworn there was ! sorry !! "
I would have thought there was something more to getting someone arrested when there isnt an injunction.....
It might be worth installing a cheap CCTV in your house....

what i plan to achieve is to be left alone without fear of being arrested for driving past her, or just because she's seen me. I have lost 2 jobs due to these allegations and the one job I studied hard at college to learn engineering and earned a fair wage from it, but it went and so did my taxi job as council started getting on my back constantly harassing me for my ex constantly reporting me to them for anything she could think of.
i'm not after money or anything, just freedom to be left alone and be treated fairly.
i give the police since august to sort the footage and statement and still refuse to so last night i posted it on you tube and facebook and soon will be sending it to house of commons, media, and other avenues to get it out there
it dont bother me what officers have or havent done but it bothers me when i cant even do my job without being arrested at the drop of a hat

The police are not going to get involved in this it is a matter between you and your ex.
If you get an injunction then your ex can be arrested if she breaks it.
Don't bother with sending this to the house of commons, newspapers etc as they will not be intrested and it will NOT help your case. You DO need to get an injunction though so start making a diary of every time she contacts you.

Eddie is right and certainly being practical
and yes we are aware of the irony
every time your ex says you looked at her and froze her blood - you get arrested
and every time you say she is perjuring herself, you are told it is nothing to do with anyone besides yourself.
this analysis, is probably accurate
