Your local Family Court (which is normally part of the Magistrates Court) may also be able to provide you with some advice about the procedures. (Some people have an automatic right to apply for an order. Others have to seek 'leave to apply' first).

Hi,
you don't give too many details so in light of that i would suggest you get yourself a good solicitor and apply to the court via them. If the other parent then objects, you have a solicitors view already.
you can do this without the solicitors help, but by personal experience, i wouldnt chance it.
