How long does a charging order/county court judgement last if it cannot be paid off in full I no court judgements last for six years but are monies owed written off after that period of time or do payments have to be made for a longer term or till debt is satisfied
A charging order can remain until you sell your property I believe. The person that you owe money to can also apply for an order of sale and apply to the courts who can make you sell your house and pay back what you owe.
I don't think either a charging order or a CCJ are written off after 6 years. Assuming that you had been paying in installments, you would just continue with these until the debt was paid.
It does not get "written off" at all. It remains on the title deed until the debt is paid in full or until the property is sold. Whoever holds the charge can object to any proposal by the debtor to sell the property but there can sometimes be circumstances where a Court agrees the property can be sold even if it results in the charged debt not being paid off.
If that happens, the remaining debt becomes unsecured as there is no property it can be charged on unless the debtor buys a fresh property & a new charging order is approved by the Court against it.
I think your 6 year point relates to how long CCJs stay on the Credit Reference Agency records. The CCJ still exists after that point & can still be used.
