My husband recently did some work for a buisnessman. He is refusing to pay and ignores any reminders. Is there anything we can do? My husband has just started up an IT business and this was his first job!
basically - LBA - letter before action sahying he will sue if the bill aint paid
and then small claims court ( very very many thread on this )
which nowadays you have to start off at MCOL
( money claims on line )
What sort of IT work? I know it may seem irrelevant but if say for example it was doing website design + hosting, your husband could just 'down' the website.
My brother had the same problem when he installed a remote CCTV system for a company. They didn't pay so he connected to it and shut the whole thing down. They asked him to look at it and he refused until they paid him.
Dismo has 9 dogs ( does that include himself) that he can set on him
D's advice is heavy with liability. Recent case of a roofer unroofing his work on no payment and getting a conviction for criminal damage.
Revlon ( 20 y ) fired their sofr ware engineer
and he had put in a trojan that if he wasnt on the pay roll, the whole databank erased itself.... and got a billion dollar suit not surprisingly
antoher sucked out the programme from the mainframe remotely and he also was sued
Many thanks to both for advice. He has already threatened legal action, but will put it in writing. The work involved setting up and networking computers, many hours of work!
PP: You have a point but there was no need to call me a dog.
I do believe however that there is a huge difference between cutting out access to a CCTV system (which is still running and recording) and removing a roof. Planting a trojan inside the system prior to knowing you're going to be sacked is not only illegal but immoral.
You are right though, this is in law and it would be wrong to suggest breaking it.
My apologies Lindahl - I got a little carried away.
