why do a lot of competitions/offers have the term "excludes ROI"- isn't that discriminating against them?

For more on marking an answer as the "Best Answer", please visit our FAQ.Doesn't the law state (in England and Wales) that in order to have a special offer there must still be an area in the country that has the 'normal' price otherwise it is not an offer as everywhere is selling at the same price? I recently saw this for KFC on mothers day where Tyne Tees were not included in the offer. Not sure about ROI though and whether this includes them?
