Uk Law Question (Abusive Parents, Non Sexual)
17 Answers
I want to prosecute my parents for childhood "medical abuse" - but how do I do this, now that "Munchausen syndrome by proxy" is no longer recognised?
I have to represent myself as I can't get legal aid (it doesn't apply for this sort of case) - and no way can I pay for a lawyer (unemployment, debt problem etc).
So - what can I charge them with? (Note: citations of relevant Sections from relevant parliamentary Acts would be helpful).

Its now called "fabricated or induced illness". I don't understand what you mean by no longer recognised as this is from the NHS website.

What outcome do you want from prosecution?
have you seen a counsellor?

We need to know a LOT more about what happened to have any chance of giving you a sencible answer.
From what you have said so far it could be just that you think they gave you the wrong cough mixture!
As NJ says it is the CPS who prosecute someone unless you have the cash and knowledge to start a private prosecution. VERY EXPENSIVE !!!!

Interesting article here - mainly for readers rather than the OP

Munchausen syndrome by proxy is still recognised but has changed its name for FII Factitious or induced illness
odd you should mention it: I bought my edition of Gray Anatomy ( first of course ) from the Gilkes who described the eye signs in this.
[ Gilkes MJ, Mann TP. The fundi of battered babies. Lancet 1967;II:468.]
I can guarantee no one on these threads has done this
NJ may be able to tel you the criminal charges usually brought in these cases - I guess ABH or GBH of the Offences against the person act 1861
or attempted murder common law
good wiki article for those interested

Even private prosecutions normally use a barrister to actually present the case.
It is just that the solicitor/barrister is hired by a private individual rather than by the CPS.
There are very few 'DIY' private prosecutions. I assume you are going down the DIY route, do you have the knowledge and skill to face a court on your own? You will be up against barristers who have had years at law and have full leagal teams behind them.

but there is still a right in the UK to bring private prosecutions preserved by statute ( no I cant give chapter and verse )

make sure the offence you choose does NOT require the consent of the attorney--general as he may well not give it
I am not gonna bother to tell you whether this is worthwhile or not ....

I am glad you have recovered from the doldrums. There was me thinking that you thought it was futile and peeing against the wind to deal with bureaucracy.
They were all wrong because you know the rules!!.Glad you now have recovered and feel you can give advice on how to fight the system.
Good Luck

I can't bring a private prosecution because I can't afford it (unemployed, deep in debt, only about £1000 in the world).
I've already got my GP on side and I'm about to start seeing a psychologist.
If you really need more details, go to the similar Yahoo site and look for question/index?qid=20150417063543AAIvay6
I REFUSE to believe there is no offense they can be charged with under UK law.

Can you post the yahoo site as a link on here so we can all see it?
If you can't afford a private prosecution and the CPS will not look at the case how do you expect to get anything done?
What would you expect to achieve if you could prosecute , compensation?, your parents put in jail or fined?.
I have some personal expirence of this situation, my daughter was accused of Munchausen by proxy. But I can't get to your yahoo link and I need more information .

IfIf you are looking for the CPS to being a prosecution your first stop must be to make a complaint to the police. They will consult the CPS after taking details of your complaint and the cps will decide what, if any, offence can be considered for prosecution. That's the only realistic route to a prosecution that you have.
