The whole point of declaring incest as wrong is to avoid the combination of genes from folk who are close on their family tree, and the potential health issues that are risked by that. Regardless of how it was accomplished, that would have been what occurred. (It would be looking for loopholes to claim it is not because physical intercourse did not occur. The raison d'etre for the labelling this as wrong, has been ignored.) However as the mother only offered her womb as incubator then it is outside of any reasonable definition of incest.
